hmmmmmm..ok seeing you asked so nicely....

Alrob rekons that padding/mats in "all" gyms is excesive--which in some cases is true, but hardrock has the best i've seen with that nice protective floor. the mill on the other hand with its carpet-on-concrete has a less than comfortable landing. the mill uses a stich-plate set up, hardrock a grigri with back slow pully-not that i'm bitchen here, just looking at the differences between the two merely as an example.

the point IMHO is both responsibilty and duty of care, the later certainly being an issue that most litigants will want to argue over.
What is the duty of care to be provided by a gym owner. what are unsafe practices?
someone climbing up a campus board without a rope-whose responsible, who has the duty of care?

this is a very different case to the situation in Sydney a few yrs a go where a high school student suffered spinal injuries resulting from a fall at a commercial climbing gym, wher the gym was held to be negligent in its duty of care of training and instructing the students.

If someone goes up higher than they should without a rope and hurts themselves, who has the duty of care, who is responsible?

Yes there are degrees of saftey, but there is also degrees of responsibilty and if people are not keen to take any responsibility then perhaps climbing is the wrong sport to be in?
