If you think about it the only ones who win from negligence cases are LAWYERS. You get hurt, so you employ one to get you compensated, then the gym hands it onto their insurance company, then they get their own lawyer. And the lawyers argue... Then the lawyers get paid; either because you won, and the insurane co lost; or vice versa...
